Second Offense DUI Charge Dismissed in the Providence District Court on November 14th, 2022

(1) SECOND OFFENSE DUI CHARGE
(2) CHEMICAL TEST REFUSAL CHARGE
(3) PROBATION VIOLATION

Marin and Barrett is pleased to announce another successfully defended DUI and refusal charge.  Our client was pulled over by the State Police for speeding on Route 146.  After a brief investigation the Trooper arrested our client and charged him with DUI and chemical test refusal.

While the state prosecutors routinely agree to dismiss criminal DUI charges in exchange for chemical test refusal pleas, our client had a prior DUI conviction so the prosecutor wanted a conviction.  Instead of simply entering a guilty plea, our attorney forced the issue and scheduled the case for trial.  Once the trial rolled around, the Prosecutor was left trying to win an un-winnable case and was forced to dismiss the matter on the spot.  We where therefore able to avoid jail time and a second offense conviction for our very grateful client.
