Domestic Violence Charges Dismissed in the Providence District Court on November 16th, 2022

Marin and Barrett, Inc., is pleased to announce a successfully defended case of domestic simple assault and domestic disorderly conduct. Our client was charged with the domestic offenses after Pawtucket Police responded to a 911 call of a domestic disturbance. The alleged victim reported to the Pawtucket Police that our client slapped her and fled when she dialed 911.
After being retained we contacted the prosecuting police department and requested a copy of the police report. We also reached out to the alleged victim to ascertain what happened the night of the altercation. Upon discovering that the altercation was an exaggeration of what actually occurred, we asked the alleged victim to come to court to address the allegations. At the first court date, we reviewed the allegations with the prosecutor and the alleged victim. After advocating for our client, the prosecutor agreed to dismiss the case with no conditions. As a result of the dismissal, our client avoided a conviction, mandatory domestic violence classes, and fines by the court. Additionally, a motion to seal (expunge) was immediately filed with the court to remove all documentation of the client's arrest and court proceedings from his record.
