Firearms Charges Favorably Resolved with a Deferred Sentence in the Newport County Superior Court on 7/12/23

Attorney Jason Ollman of Marin and Barrett Law Firm achieved a significant victory in a complex legal case at Newport County Superior Court. Our client faced multiple charges, including possession of a firearm without a license, possession of a firearm while intoxicated, DUI, and trespassing. The incident occurred when our client, in a case of mistaken identity, approached the wrong residence while under the influence of alcohol.

Upon receiving a complaint of an unwanted and unknown party, the Tiverton Police responded and discovered our Client in his parked car with a firearm that was improperly stowed. Recognizing the severity of the charges, our Defense Team swiftly developed a robust strategy.

Through careful analysis, we exposed weaknesses in the prosecution's case, highlighting the lack of observed operation for the DUI charge. Additionally, we showcased the positive steps our Client had taken since the incident, including engaging in counseling. Leveraging these arguments, we negotiated a favorable outcome for our Client.

We are thrilled to announce that the DUI and trespassing charges have been dismissed. Our client received a 5 year deferred sentence on the firearms charges, avoiding a felony conviction and eliminating the need for felony probation. This resolution allows our client to move forward with their life while taking responsibility for their actions.

CASE RESULTS: DUI AND TRESPASSING CHARGES DISMISSED, CLIENT RECEIVED A 5-YEAR DEFERRED SENTENCE ON THE FIREARMS CHARGES on July 12th, 2023.
