Possession of Cocaine Charges Successfully Resolved in Providence County Superior Court on April 14th, 2023

CHARGE: (1) POSSESSION OF A CONTROLLED SUBSTANCE (COCAINE) LESS THAN 10 GRAMS
Attorney Kensley Barrett of the Marin and Barrett Law Firm successfully defended a client charged with possession of a controlled substance (cocaine) less than 10 grams. On February 3rd, 2022, the client was a passenger in a motor vehicle stopped by a Central Falls Police Officer at about 11 pm. Due to the suspicious behavior of the vehicle's occupants, a search was conducted, which revealed a small bag containing a white powder substance in the client's left shoe. The substance was seized, and the client was arrested and charged with possession of a controlled substance. Lab testing later confirmed that the substance was cocaine.
The client was arrested by the Central Falls Police and charged with possession of a controlled substance (cocaine) less than 10 grams. The attorney enrolled the client in an outpatient treatment program, which they successfully completed. At the first Pre-Arraignment Conference (PAC) date, the attorney provided mitigation to the prosecution and the court, including information about the client's employment, lack of a criminal record, and substance abuse treatment. The prosecution agreed to defer the case for a period of one year. The client avoids a conviction, and the case is eligible to be sealed/expunged after the one-year deferred period expires.
CASE RESULTS: ONE YEAR DEFERRED SENTENCE which will be eligible for expungement upon completion (no further trouble) of the deferred sentence on April 14th, 2023.
