CHARGE: DOMESTIC SIMPLE ASSAULT AND BATTERY
In a recent legal victory, Marin, Barrett & Murphy successfully represented a client facing charges of Domestic Simple Assault. The case was brought forth by the Bristol Police Department and centered on an altercation between the client and his girlfriend. The incident in question occurred when the Client and his girlfriend were involved in a heated dispute outside their residence. A neighbor claimed to have witnessed the client verbally and physically assault his girlfriend, prompting them to contact the police.
Marin, Barrett & Murphy promptly initiated a thorough legal defense by reviewing all available evidence and the discovery related to the case. To gain a complete understanding of the situation, the legal team reached out to the girlfriend to obtain her firsthand account of the events that transpired on the specified date. Crucially, the girlfriend vehemently disputed the neighbor's allegations, providing a sworn affidavit confirming that she did not request police intervention on the day of the incident. She also expressed her desire not to see charges pressed against the client.
In an effort to strengthen the client's case and demonstrate a commitment to addressing the underlying issues, our Defense Attorneys advised the client to enroll in anger management counseling. The client completed the recommended program successfully. Armed with the affidavit from the girlfriend, the letter certifying the completion of anger management counseling, and a robust defense strategy, Marin, Barrett and Murphy argued their case to the prosecutor.
The prosecutor, acknowledging the girlfriend's disavowal of the allegations and the client's proactive steps toward self-improvement, made the decision to dismiss all charges against the client. This favorable outcome not only spared the client from a domestic violence conviction but also enabled the client to bypass the mandatory domestic violence course typically associated with such a conviction. Furthermore, the client is now eligible to have the case expunged from their record without delay.
