DUI Charge Amended to Driving While Impaired in the Washington County Superior Court

October 2023

Charges:
(1) DUI (BAC Unk)
(2) Refusal to Submit to Chemical Test
(3) Laned Roadway Violation
(4) Possession of Marijuana
(5) Operating a Vehicle without Evidence of Insurance

Our client, a freshman at the University of Rhode Island (URI), found himself in a challenging legal situation. After leaving a party, he encountered difficulties while operating his vehicle, ultimately veering off the road and onto the highway shoulder. The situation escalated when law enforcement arrived at the scene. Following questioning, our Client was arrested on charges of DUI, refusal to submit to a chemical test, laned roadway violation, possession of marijuana, and operating a vehicle without evidence of insurance.

Defense counsel, led by Attorney Angelica Bovis, promptly engaged with the client, providing essential guidance regarding the available legal pathways to navigate the case. After thoroughly discussing the client's objectives, Attorney Bovis initiated negotiations with the prosecution to seek the most favorable outcome.

Through skillful negotiations and a well-structured defense strategy, Attorney Bovis was able to secure the following results:

  1. Amendment of DUI Charge: The misdemeanor DUI charge was successfully amended to a civil violation of "driving while impaired." This amendment significantly benefits the client, as it will not negatively impact his background when pursuing future job opportunities.

  2. Dismissal of All Traffic Violations: In a favorable turn of events, all other traffic violations, including the refusal to submit to a chemical test, were dismissed, relieving the client of further legal penalties associated with these charges.

As a result of Attorney Angelica Bovis' dedicated legal representation, our client experienced a significant victory. The amended charge of "driving while impaired" minimizes the potential long-term consequences, especially in terms of future job prospects. Moreover, the dismissal of all other traffic violations underscores the success of this defense strategy.
