CHARGE: DOMESTIC DISORDERLY CONDUCT (R.I.G.L. 11-45-1)
Once again, Attorney Matthew Marin with Marin and Barrett, Inc. is pleased to report the dismissal of domestic disorderly conduct charges that had been brought against a Client in the Kent County District Court. Police officers in Kent County responded to a complaint made by an individual claiming that threats had been conveyed to them via Facebook. The Police reviewed the written exchanges on Facebook and arrested the Client for domestic disorderly conduct for violent, threatening, or tumultuous behavior.
After being hired to handle the matter we promptly got to work securing a good outcome. At the first pre-trial conference we were able to impress upon the prosecutor that a long line of case law regarding the First Amendment and protected speech require that the Prosecutor terminate the prosecution. Ultimately, the Prosecution agreed and the charges were fully dismissed.
