Suspended License Charge:
Laws and Penalties
(Section 31-11-18.1)

FIRST OFFENSE -
  • 3 Month Additional Loss of License Minimum
  • Mandatory Five-Hundred (500) Dollar Fine
  • Mandatory Ten (10) Days Minimum in Jail if the Suspension was a result of DUI, Breathalyzer Refusal, Reckless Driving, Operating to Endanger or Three Moving Violations within a one-year period

SECOND OFFENSE (within 5 years) -
  • 6 Month Additional Loss of License Minimum
  • Mandatory Five-Hundred (500) Dollar Fine
  • Mandatory Six (6) to Twelve (12) Months in Jail if the Suspension was a result of DUI, Breathalyzer Refusal, Reckless Driving, Operating to Endanger, or Three Moving Violations within a one-year period

THIRD OFFENSE (within 5 years) -
  • Mandatory One-Thousand (1,000) Dollar Fine
  • Up to One (1) Year in Jail and/or Participation in a Public Service Program
  • Minimum of One (1) Year in Jail if the Suspension was a result of DUI, Breathalyzer Refusal, Reckless Driving, Operating to Endanger, or Three Moving Violations within a one-year period

Are there Defenses?

Yes, there are legitimate defense strategies based on the reasons for the stop, as well as the possibility that your license should not have been suspended in the first place, and DMV errors.

Even if you weren’t aware that your license had been suspended, you can still be charged.
