CHARGE: RECKLESS DRIVING / ELUDING

In a recent legal victory, the Marin, Barrett, and Murphy Law Firm effectively defended a client facing charges of Reckless Driving/Eluding in the Providence District Court. The case arose from an incident on January 2, 2024, when a City Police officer purportedly observed our client driving at a high speed. Upon activating his overhead lights to pull over the vehicle, the Officer alleged that our Client accelerated, disregarded a stop sign, and attempted to evade the police cruiser in pursuit.

Upon being pulled over, our Client allegedly admitted to attempting to flee, citing past negative encounters with law enforcement. However, upon being retained, our legal team immediately took action to protect our Client's rights and mount a strong defense.

Attorney Kensley Barrett of Marin, Barrett, and Murphy meticulously reviewed the evidence with the City prosecutor, arguing that the alleged speed of our Client's vehicle was not necessarily indicative of an attempt to elude. Moreover, it was emphasized that our Client ultimately complied with the Officer's directives, pulling over and submitting to the traffic stop.

Following extensive discussions, the City Prosecutor agreed to dismiss the case under the condition of successful completion of community service. Our client promptly fulfilled this requirement within three weeks, demonstrating his commitment to resolving the matter.  Thanks to the diligent efforts of the Attorney Kensley Barrett, our client avoided a misdemeanor conviction. Furthermore, the dismissal of the charges ensures that the case can be expunged from our client's record immediately, safeguarding his reputation and future prospects.
