Domestic Assault and Disorderly Conduct Charges Dismissed in the Washington County District Court on May 18th, 2023

In a recent case handled by Marin, Barrett and Murphy, our client faced charges of Domestic Simple Assault and Domestic Disorderly Conduct brought by the South Kingstown Police Department. The charges stemmed from a report of a domestic disturbance, with the reporting party alleging that our client, his girlfriend, assaulted him following an argument.

Upon being retained, our dedicated legal team immediately took action. We met with the client and obtained a copy of the police report from the SKPD. Recognizing the potential for a positive resolution, we reached out to the complaining witness to gather more information. To our satisfaction, the complaining witness asserted that the incident was a misunderstanding and expressed his desire not to pursue prosecution against our client.

In collaboration with the complaining witness, we crafted an affidavit of non-prosecution. This document, signed and notarized by the complaining witness, stated that he had no fear of our client, did not wish to see her prosecuted, and willingly provided the affidavit of his own free will. We also recommended that the complaining witness appear at the arraignment date to further support our case.

During the arraignment/first court date, our experienced attorneys presented the signed affidavit of non-prosecution to the South Kingston Solicitor. Additionally, we facilitated a conversation between the solicitor and the complaining witness. As a result of our diligent efforts, the case was ultimately dismissed, and the no-contact order was lifted.
