CHARGE: OBSTRUCTING AN OFFICER IN THE EXECUTION OF HIS DUTY
Attorney Kensley Barrett with Marin and Barrett, Inc., is pleased to announce a successfully defended case of an obstructing an officer in execution of his/her duties. Our client, who is a military veteran, was inside a Warwick restaurant and asked to leave the premises by management. Warwick police arrived on scene and asked that our client provide his name so that he could be trespassed from the restaurant. Our client, refused to provide the requested information and he was subsequently charged with obstruction,
After being retained we contacted the prosecuting police department and requested a copy of the police report. At the first court date, we reviewed the allegations with the prosecutor and the judge. After advocating for our client, the prosecutor agreed to dismiss the case with no conditions. As a result of the dismissal, our client avoided a conviction and avoided fines by the court. Additionally, a motion to seal (expunge) was immediately filed with the court to remove all documentation of the client's arrest and court proceedings from his record.
RESULT: OBSTRUCTION CHARGES DISMISSED in the Kent County District Court on October 31st, 2022
