Attorney Angelica Bovis of Marin & Murphy Law Firm achieved a significant victory in a serious felony case at the Providence County Superior Court. Our Client was accused of fraudulently collecting unemployment benefits for approximately one year during the Covid-19 pandemic. After an investigation, the State alleged that he was overpaid almost $20,000 in benefits. The prosecution obtained evidence of the benefits paid as well as pay stubs from his job and the Client was subsequently charged.
Early on, Defense counsel recognized that the evidence is not very favorable to the accused, and discussed to our Client the best way to approach the negotiation of a resolution to the case. After presenting extensive mitigation about the Client to the Prosecution, including the fact that he has never been arrested before and supports his large family with two jobs, the Prosecution and the Court agreed to resolve the case with a deferred sentence and restitution payments. This resolution allows the Client’s record to be expunged immediately upon the completion of the sentence. Because the restitution was so large, the sentence would be extended for a period of 10 years to allow restitution to be paid.
CASE RESULTS: CLIENT RECEIVED A 10-YEAR DEFERRED SENTENCE WITH RESTITUTION on December 14th, 2023
