Drug and DUI Charges Dismissed in the Providence County Superior Court on 4/20/2021

(1) POSSESSION OF A CONTROLLED SUBSTANCE (FENTANYL)
(2) DUI (FIRST OFFENSE - BAC UNKNOWN)
(3) REFUSAL TO SUBMIT TO A CHEMICAL TEST (FIRST OFFENSE)
(4) LEAVING THE SCENE OF AN ACCIDENT
(5) RECKLESS DRIVING
The criminal defense attorneys at Marin & Barrett, Inc. are extremely pleased to report the complete dismissal of several serious criminal offenses that had been brought against a Client in the Providence County Superior Court. In July of 2019, the Police were dispatched to the scene of a multi-car motor vehicle accident in which the driver that had caused the accident had fled the scene. A short ways away down the road, the Police were able to locate the other vehicle and driver which had crashed disabling the vehicle. Our Client was unresponsive and appeared to have suffered an overdose. He was taken to the hospital and arrested for DUI, leaving the scene of an accident, and reckless driving. Upon searching his belongings, the Police found a white powdery substance they believed to be fentanyl and charged him also with felony possession of a controlled substance.
After retaining us to help fight the case, we immediately got to work both reviewing the evidence and advising our Client about the steps he can take to improve his situation. Taking our advice, our Client admitted himself into intensive outpatient substance abuse treatment. We were able to successfully submit his criminal case to the Adult Diversion Program. After one year of substance abuse treatment and compliance with all the other required Diversion conditions, our Client plead guilty to the civil chemical test refusal charge at the Rhode Island Traffic Tribunal. Based on the counseling completed and the admission to the chemical test refusal charge, we were able to negotiate a dismissal of the drug possession charge, the driving under the influence charge, the leaving the scene of an accident charge, and the reckless driving charge. Our Client not only avoided jail time and even probation, but walks away with a free and clear criminal record.
