Driving on a Suspended License First Offense Civil Violation Expunged July 2020

July 2020

CHARGE: DRIVING ON A SUSPENDED LICENSE (FIRST OFFENSE - CIVIL VIOLATION)

The attorneys at Marin & Barrett, Inc. are extremely pleased to announce that they not only secured another successful outcome for a client, but in the process created new binding precedent to help clients in the future.

Back in 2017 our client was arrested and charged with driving while on a suspended license; after getting his license back his case was dismissed in court.  However the case remained on his criminal record, so he contacted us in order to get the case expunged for good.  Despite filing the proper paperwork and arguing the motion in the District Court, the judge denied the motion and rule that the charge must remain on his record.  Rather than accept the outcome, the attorneys fought the case all the way to the Rhode Island Supreme Court.  After months of briefing and research the case was argued before the full panel Judges and several months later the Court issued a written decision overturning the District Court Judge and ruling in favor of our client.

RESULT: CASE EXPUNGED

Practice area(s): Criminal Defense

Court: Kent County District Court
