CHARGE: Misdemeanor Driving on a Suspended License
Our client sought relief from a criminal driving on a suspended license charge dating back to 2016, arising from a Cranston Police Department case. At the time, the client entered a nolo contendere plea and resolved the matter in May of 2016 with a $250 fine and no loss of driving privileges.
Since the resolution of the case, Rhode Island law has changed. Driving on a suspended license has been decriminalized, meaning that if the same conduct were charged today, it would be treated as a civil violation rather than a misdemeanor criminal offense.
The Firm filed a Motion for Expungement in Kent County District Court, arguing that the charge was now eligible for expungement because the underlying conduct no longer constitutes a criminal offense under current law. The court agreed with this legal argument.
As a result, the client was able to clear the criminal charge from their record entirely, eliminating the long-term consequences associated with a misdemeanor conviction.
CASE RESULT: Misdemeanor Driving on a Suspended License charge expunged; criminal record cleared. Expungement granted on January 20, 2026.
