CHARGE(S): Domestic Simple Assault; Domestic Vandalism
Our client was charged with domestic assault and vandalism after being accused of assaulting his girlfriend and damaging her room during an alleged incident. The charges exposed the client to a criminal record and the significant consequences associated with a domestic violence prosecution.
Attorney Phillip Wullschleger investigated the allegations and spoke with the witnesses involved in the case. Through that investigation, Attorney Wullschleger learned that the complaining witness did not want the client prosecuted, but instead wanted him to obtain mental health treatment and address the circumstances that had contributed to the incident.
Attorney Wullschleger presented this information to the prosecution and negotiated a resolution focused on treatment rather than a criminal conviction. The client agreed to complete an Anger Management program and enroll in counseling in exchange for dismissal of the charges.
On June 24, after the client satisfied the agreed-upon requirements, the domestic assault and vandalism charges were dismissed in the 6th District Court.
CASE RESULT: Domestic Assault and Domestic Vandalism charges dismissed following completion of Anger Management and enrollment in counseling on June 24.
