Child Pornography Charges Successfully Resolved in Washington County Superior Court on May 19th, 2023

CHARGES:
(1) POSSESSION OF CHILD PORNOGRAPHY
(2) TRANSFER OF CHILD PORNOGRAPHY
Attorney Kensley Barrett of Marin, Barrett & Murphy Law Firm successfully defended a case involving a client charged with possession of child pornography and transfer of child pornography. The charges stemmed from a tip by the FBI that lead to an investigation by the local South Kingstown Police Department on 2018.
After a review of the police report and discovery materials, Marin Barrett & Murphy determined that there were issues with the evidence in the case and argued for an amendment to the charge. After extensive research by Marin Barrett & Murphy and negotiations with the Attorney Generals' Office, the State agreed to dismiss the charge of transferring child pornography and amended the charge of possession to accessing a computer for fraudulent purposes. Further, the State agreed to defer the case for three years, resulting in no community registration, no special conditions, and no conviction for the Client. The Client is eligible to have the amended charge sealed from his record at the conclusion of the three year period.
CASE RESULTS: POSSESSION OF CHILD PORNOGRAPHY AMENDED TO ACCESSING A COMPUTER FOR FRAUDULENT PURPOSES AND TRANSFER OF CHILD PORNOGRAPHY DISMISSED. Sentencing on the case was deferred for three years, providing an opportunity for a fresh start on May 19th, 2023
