Attorney Murphy: Editor of Rhode Island’s Authoritative DUI Trial Guide
Attorney Stefanie A. Murphy serves as Editor of A Practical Guide to Trying DUI Cases in Rhode Island (MCLE, 2nd Edition 2024), the definitive legal practice manual for DUI litigation in Rhode Island. Published by Massachusetts Continuing Legal Education—the leading CLE provider in New England—this 362-page guide is used by prosecutors, defense attorneys, and judges throughout Rhode Island as the authoritative reference for DUI trial practice.
As Editor, Attorney Murphy oversaw contributions from Rhode Island’s leading DUI practitioners, prosecutors from the Rhode Island Attorney General’s Office, judges from the Rhode Island Traffic Tribunal, and law enforcement officials. She also authored multiple chapters, including comprehensive coverage of pretrial motions practice and statutory authority for Rhode Island drunk driving law.
The guide covers every aspect of Rhode Island DUI litigation, from initial police stop through trial and appeal, including search and seizure law specific to DUI cases, breathalyzer and field sobriety test challenges, blood evidence and chemical testing procedures, pretrial motions practice and suppression strategies, trial preparation and jury instructions, ignition interlock devices and hardship licenses, and DUI sealing and expungement procedures.
This publication underwent rigorous peer review and reflects the collective expertise of Rhode Island’s DUI legal community. Attorney Murphy’s role as Editor demonstrates recognition by her peers—including prosecutors, judges, and fellow defense attorneys—of her exceptional knowledge of Rhode Island DUI law and trial practice.
What does this mean for clients? When you hire Attorney Murphy, you’re working with the attorney who literally wrote and edited the guide that other Rhode Island DUI attorneys—and prosecutors—study to prepare their cases. She brings the same analytical depth, attention to procedural detail, and comprehensive understanding of DUI law to every client case that she brought to editing this authoritative legal practice manual.
Our Approach to Criminal Defense
We believe effective criminal defense requires more than courtroom skill—it requires listening to our clients, understanding their concerns, and maintaining open communication throughout their case. When you’re facing criminal charges, you need attorneys who will take the time to hear your story, respect your situation, and fight aggressively to protect your rights and freedom. That’s what we deliver at Marin & Murphy Law Firm.
Our approach is built on three principles: meticulous preparation, disciplined advocacy, and a case-specific strategy focused on achieving the best possible outcome for each client. Whether you’re facing your first DUI or serious felony charges, we invest the time to understand your circumstances, explain your options clearly, and develop a defense strategy tailored to your specific case. Every client deserves to feel heard, understood, and confident that their attorney is fighting for them at every stage of the legal process.
We offer what solo practitioners can’t: a full legal team focused on your case, with the combined expertise of senior and associate attorneys working together on your defense. And what large firms won’t: personal attention from experienced trial attorneys at every stage of your case. This team approach means you benefit from multiple legal perspectives, thorough case preparation, and the depth of resources needed to mount an effective defense—whether that means challenging the evidence against you, negotiating with prosecutors, or taking your case to trial.
Our History
Marin & Murphy Law Firm was founded in 2008 by Attorney Matthew T. Marin with a singular focus: aggressive DUI defense rooted in constitutional advocacy and courtroom results. What began as a solo criminal defense practice has evolved into a specialized team of trial attorneys serving clients throughout Rhode Island. We’ve grown from defending cases in a single courthouse to maintaining a statewide practice that regularly appears before every Superior Court and District Court in Rhode Island.
Today, our firm operates from offices in East Greenwich and Cranston, with convenient meeting locations throughout Rhode Island including Providence and South Kingstown. This expansion reflects our commitment to accessible, client-focused representation—wherever you are in Rhode Island, our attorneys can meet with you to discuss your case.
We’ve evolved from a solo practice into a specialized criminal defense team, combining the personalized attention of a boutique firm with the depth of a multi-attorney practice. Our attorneys bring decades of combined trial experience, including murder acquittals, Rhode Island Supreme Court victories, and thousands of successful DUI defenses. Led by founding partner Matthew T. Marin and partner Stefanie A. Murphy, with support from associate attorneys dedicated to criminal defense, we’ve built a practice focused on one goal: protecting our clients’ constitutional rights and achieving the best possible outcomes in their cases.
Throughout our firm’s growth, our commitment has remained constant: every client receives experienced, thorough representation from attorneys who know Rhode Island criminal law, understand how prosecutors build their cases, and have proven their ability to win in the courtroom.
Meet Our Attorneys

Stefanie A. Murphy, Partner
Attorney Stefanie A. Murphy is a Rhode Island criminal defense attorney with over 20 years of experience defending felony and federal cases in Rhode Island Superior Court and U.S. District Court. Her practice focuses on trial-level criminal defense, handling cases from investigation through resolution and representing clients in jury trials and complex felony proceedings. She routinely defends clients facing felony and misdemeanor charges carrying significant legal, professional, and personal consequences.
Attorney Murphy serves as Editor of A Practical Guide to Trying DUI Cases in Rhode Island (MCLE, 2nd Edition 2024), the authoritative legal practice manual used by prosecutors, defense attorneys, and judges throughout Rhode Island for DUI trial preparation. As editor, she curated contributions from leading practitioners including prosecutors, judges, and law enforcement officials, and authored multiple chapters on pretrial motions practice and DUI statutory authority. This editorial role—overseeing Rhode Island’s definitive DUI trial guide—reflects peer recognition of her exceptional expertise in this complex area of criminal defense.
Attorney Murphy secured a not guilty verdict in State v. Winslow (2023), a highly publicized murder case where co-defendants were serving life sentences for the same incident. The case was prosecuted by the Rhode Island Attorney General’s Office and received extensive Providence Journal coverage. This murder acquittal stands as one of Rhode Island’s rare not-guilty verdicts in homicide cases and demonstrates the highest level of trial competence and jury advocacy.
Beyond murder defense, Attorney Murphy serves as court-appointed counsel in the a post-conviction DNA case, advocating for the release of a man who spent decades in prison for a 1985 rape conviction. Murphy has argued that newly discovered DNA evidence excludes her client as the perpetrator, navigating complex issues involving wrongful convictions, eyewitness misidentification, and advances in forensic science. The case has been featured extensively in the Providence Journal, with Murphy quoted advocating for justice and constitutional protections.
Attorney Murphy has defended over 2,500 DUI cases throughout her career, securing hundreds of breath test suppression victories and dozens of successful outcomes in refusal cases at the Rhode Island Traffic Tribunal. Her DUI defense work includes challenging breath, blood, and urine test results; litigating constitutional issues involving search and seizure; and representing clients in cases involving Rhode Island State Police arrests on major highways including I-95 and I-295.
She regularly appears in all Rhode Island Superior Courts (Providence, Kent, Washington, and Newport Counties), all major Rhode Island District Courts (6th Division Providence, 3rd Division Warwick, 4th Division Washington County, 2nd Division Newport), the Rhode Island Traffic Tribunal, and federal court (U.S. District Court for the District of Rhode Island). Her trial experience spans domestic violence prosecutions, drug trafficking cases, sexual assault defense, federal criminal matters, and complex constitutional litigation involving suppression motions and Fourth Amendment challenges.
Attorney Murphy has been repeatedly identified and quoted by independent media, including the Providence Journal, in connection with high-profile criminal cases and issues affecting criminal defendants’ rights. Her work has been featured in reporting on felony prosecutions, wrongful-conviction litigation, and DNA-based post-conviction proceedings. She has also been quoted on impaired-driving enforcement, including DUI cases involving breath and blood testing, refusal allegations, and evidentiary challenges following marijuana legalization. She is quoted in Rhode Island Lawyers Weekly, a specialty legal publication, on developments in criminal procedure and DUI law, reflecting professional recognition within the Rhode Island legal community.
In the past few years, Attorney Murphy provided formal instruction to Rhode Island Municipal Police Academy recruits on DUI and DWI enforcement, including impaired driving investigations, evidentiary requirements, and constitutional considerations affecting prosecutions. This training experience gives her unique insight into how police officers are trained to build DUI cases—knowledge she uses to identify weaknesses in the prosecution’s evidence and protect her clients’ rights.
Attorney Murphy is a member of the Rhode Island Association of Criminal Defense Lawyers (RIACDL), National Association of Criminal Defense Lawyers (NACDL), the National College for DUI Defense (NCDD), and serves as the Rhode Island affiliate for the ACLU. Attorney Murphy has been selected as a Super Lawyers Rising Star from 2012 to 2018, followed by consecutive Super Lawyers selections from 2019 to 2025 — representing 14 consecutive years of peer recognition among Rhode Island’s top criminal defense attorneys. She is known for meticulous preparation, disciplined advocacy, and a case-specific approach focused on protecting clients’ rights and minimizing the long-term consequences of criminal charges. Her work emphasizes careful legal analysis, strategic judgment, and principled representation in complex criminal matters.

Matthew T. Marin, Founding Partner
Attorney Matthew T. Marin founded Marin & Murphy Law Firm in 2008 with a focus on aggressive DUI defense and constitutional advocacy. His early prosecution experience at the Rhode Island Department of Attorney General—where he represented the State in probation and bail violation hearings and prosecuted breathalyzer refusal cases at the Rhode Island Traffic Tribunal—gave him invaluable insight into how prosecutors build their cases. Attorney Marin understands prosecution strategy from the inside, which informs his defense approach and helps him identify weaknesses in the State’s evidence.
Attorney Marin successfully argued for suppression of breath test results in the landmark 2015 Rhode Island District Court case State v. Zimmerman, challenging the adequacy of the state’s DUI Rights for Motorists form. This litigation led to multiple judicial rulings finding the form misleading and ultimately prompted the Rhode Island Attorney General’s Office to revise the form statewide to better inform motorists of their rights under amended DUI laws. Rhode Island Lawyers Weekly identified Attorney Marin as “leading the charge” among defense attorneys challenging the admissibility of chemical test results based on the rights-form language. This constitutional advocacy affected hundreds of Rhode Island DUI cases and changed statewide procedure.
In State v. Corcoran (2022), Attorney Marin successfully argued the case at the Washington County Superior Court level, resulting in suppression of incriminating statements in a DUI investigation. The case was later argued by a firm associate and prevailed in the Rhode Island Supreme Court, establishing key precedent that roadside questioning after a collision and failed sobriety tests constitutes custodial interrogation requiring Miranda warnings. This decision significantly strengthened protections for defendants in impaired driving cases statewide.
Attorney Marin has been a featured speaker at continuing legal education programs and professional conferences, including presentations to the Rhode Island District Court Prosecutors Association on “Odor of Marijuana as Probable Cause to Search – Post Decriminalization” (2016), expert witness testimony workshops (2015), and domestic violence defense training (2011). Like Attorney Murphy, he has provided formal instruction to Rhode Island Municipal Police Academy recruits on DUI and DWI enforcement, giving him direct knowledge of police training protocols and investigative techniques.
Attorney Marin’s professional recognition includes selection as a Super Lawyers Rising Star from 2014 to 2018, followed by consecutive Super Lawyers selections from 2019 to 2024—representing 11 consecutive years of peer recognition. He is a member of the National Association of Criminal Defense Lawyers (NACDL), the National College for DUI Defense (NCDD), and the National Trial Lawyers Top 100.
As founding partner, Attorney Marin continues to oversee the firm’s operations while also leading the firm’s personal injury and mass tort litigation practice, which handles PFAS environmental contamination cases, defective product litigation, and other complex civil matters on a national scale. He has been featured as a speaker at Mass Torts Made Perfect conferences (2024, 2025) and his work has been covered in national legal and industry publications.

Morgan Alger, Associate Attorney
Attorney Morgan Alger is an associate attorney at Marin & Murphy Law Firm, admitted to the Rhode Island Bar (Bar #10896, 2024). She represents clients facing first-offense DUI charges, misdemeanor criminal matters, contested traffic violations, drug possession offenses, and expungement petitions in Rhode Island District Courts, the Rhode Island Traffic Tribunal, and municipal courts statewide.
“I came to criminal defense because I saw at Rhode Island Legal Services how much the legal system can upend someone’s life — and how much difference it makes to have an attorney who actually listens. Most of my clients have never been in trouble before. My job is to make sure they understand what’s happening, what their options are, and that someone is genuinely fighting for them.”
Before joining Marin & Murphy, Attorney Alger served as a staff attorney with the Housing Law Center at Rhode Island Legal Services, representing low-income Rhode Islanders in contested courtroom proceedings during a surge in eviction filings — work that was featured in Providence Business News (February 2025). During law school at Roger Williams University School of Law, she completed two Rule 9 legal internships with the Rhode Island Attorney General’s Office — working with the Special Victims Unit and the Narcotics and Violent Crime Unit — and served as an ABA Legal Education Police Practices Consortium Fellow studying law enforcement procedures and constitutional policing standards. She was selected as a Finalist in the 2022 Esther Clark Moot Court Competition, arguing before the justices of the Rhode Island Supreme Court.
Before law school, Attorney Alger worked as a FINRA-registered securities representative at J.P. Morgan Securities and Santander Securities in Rhode Island. She understands what is at stake when a working professional faces criminal charges — and brings that awareness of professional and financial consequences to every case she handles.
Attorney Alger holds a Juris Doctor (2024) and a Master of Science in Criminal Justice from Roger Williams University, and a Bachelor of Science from the University of Rhode Island. At Marin & Murphy, she combines dedicated one-on-one client attention with the full resources of a firm that has defended over 2,500 DUI cases, secured murder acquittals, and set Rhode Island Supreme Court precedent.

State v. Winslow (2023) – Murder Acquittal
Attorney Stefanie Murphy secured a not guilty verdict in this highly publicized 2023 murder trial. The defendant was acquitted of murder and firearm charges while co-defendants in the same incident were serving life sentences. The case was prosecuted by the Rhode Island Attorney General’s Office and involved complex issues of witness credibility, forensic evidence, and self-defense law. The murder acquittal was covered by the Providence Journal and stands as one of Rhode Island’s few reported not-guilty verdicts in homicide prosecutions, demonstrating the highest level of trial advocacy and courtroom skill.
State v. Corcoran (2022) – Rhode Island Supreme Court Miranda Precedent
This case established statewide precedent regarding custodial interrogation and Miranda warnings in DUI investigations. Attorney Matthew Marin successfully argued the case at the Washington County Superior Court level, securing suppression of incriminating statements made during roadside questioning after a collision and failed sobriety tests. A firm associate argued the case before the Rhode Island Supreme Court, which affirmed the suppression ruling. The Supreme Court held that such roadside questioning constitutes custodial interrogation requiring Miranda warnings, significantly strengthening protections for defendants in impaired driving cases throughout Rhode Island. This precedent-setting decision affects how DUI investigations are conducted across the state.
State v. Zimmerman (2015) – DUI Rights Form Constitutional Challenge
Attorney Matthew Marin successfully challenged the adequacy of Rhode Island’s DUI Rights for Motorists form in multiple 2015 District Court cases, arguing that the form was misleading and failed to adequately inform motorists of their rights under amended DUI laws. Multiple judges issued rulings suppressing breath test results based on deficiencies in the rights form. This sustained constitutional litigation ultimately forced the Rhode Island Attorney General’s Office to revise the form statewide to better protect defendants’ rights. The litigation affected hundreds of DUI cases over several months and changed statewide procedure for administering chemical test warnings. Rhode Island Lawyers Weekly featured this work extensively, describing Attorney Marin as “leading the charge” among defense attorneys challenging chemical test admissibility.
Post-Conviction DNA Case (Ongoing)
Attorney Stefanie Murphy serves as court-appointed counsel for a client in his post-conviction relief petition based on newly discovered DNA evidence. The client spent decades in prison for a 1985 rape conviction, maintaining his innocence throughout. DNA testing excludes him as the perpetrator, and Murphy has been advocating for his release through complex post-conviction litigation involving issues of wrongful conviction, eyewitness misidentification, and forensic science advances. The case has been featured extensively in the Providence Journal, with Attorney Murphy quoted advocating for justice and constitutional protections for the wrongfully convicted. This work demonstrates our commitment to protecting defendants’ rights even in the most challenging circumstances.
