RI Sex Crimes Penalties

Sexual Assault

1. First degree sexual assault
• A minimum of 10 years, a maximum of life imprisonment

2. Assault with intent to commit first degree sexual assault
• A minimum of 3 years, a maximum of 20 years imprisonment

3. Second degree sexual assault
• A minimum of 3 years, a maximum of 15 years imprisonment

4. Third degree sexual assault
• Up to 5 years imprisonment

Sex Crimes against Children

1. First degree child molestation
• A minimum of 25 years, a maximum of life imprisonment, and if paroled/placed on probation, potentially monitored via GPS for life

2. Second degree child molestation
• A minimum of 6 years, a maximum of 30 years imprisonment

3. Indecent solicitation of a child
• A minimum of 5 years imprisonment

4. Child pornography
• Producing, reproducing, or delivering child pornography – up to 15 years imprisonment and/or up to a $5,000 fine
• Possessing child pornography – up to 5 years imprisonment and/or up to a $5,000 fine

5. Soliciting an incompetent person
• Up to one year imprisonment, and/or up to a $500 fine

6. Exploitation for immoral purposes
• Allowing a child to be used in any media form to suggest that the child is engaging in any sexual act – first offense – up to 10 years imprisonment and/or up to a $10,000 fine
o Any subsequent offense – up to 15 years imprisonment and/or up to a $15,000 fine
• Using/employing a minor for prostitution or “any other lewd or indecent act” – up to 20 years imprisonment and/or up to a $20,000 fine

7. Enticement of children
• Enticing a child away from his or her home/school or to enter a secluded area with “intent to engage in felonious conduct against that child” – up to 5 years imprisonment and/or a $5,000 fine

8. Video voyeurism (Victim under 18)
• Up to 3 years imprisonment and/or up to a $5,000 fine
